YoungSkillz, Inc. (collectively, "we," "us" or "YoungSkillz") provides you access to the YoungSkillz Services (defined below) subject to the terms and conditions described in this document (this "Terms of Use") and any other guidelines, rules or licenses posted in connection with any Online or Offline Courses (defined below). This Terms of Use also includes our Privacy Policy, incorporated by this reference.
By using this Service, clicking “I Agree”, registering a User Account (defined below), purchasing an Online or Offline Course, or by indicating your agreement to this Terms of Use through a similar mechanism, you are agreeing to be bound by this Terms of Use. If you do not agree to this Terms of Use, do not use the Services. If you under the age of 18, but at least 13 years of age, you represent and agree that you are an emancipated minor or possess legal parental or guardian consent to use the Services and are fully able and competent to enter into all of the conditions, obligations, affirmations, representations and warranties set forth in this Terms of Use. The Services are not intended for, nor directed at, individuals under the age of 13 (or under the applicable age of consent in your jurisdiction); if you are under 13 years of age (or the applicable age of consent in your jurisdiction), do not use the Services.
NOTICE REGARDING DISPUTE RESOLUTION: These Terms of Use contain provisions that govern how claims you and we may have against each other are resolved (see the Section entitled ‘Arbitration’ below), including an agreement and obligation to arbitrate disputes, which will, subject to limited exceptions, require you to submit claims you have against us to binding arbitration, unless you opt-out in accordance with the Arbitration Section. Unless you opt-out of arbitration: (a) you will only be permitted to pursue claims against us on an individual basis, not as part of any class or representative action or proceeding and (b) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.
By participating in any of our Online or Offline Courses or otherwise interacting with our Services, including, without limitation, through any communities, chat rooms, or other method or media used for the purpose of providing you the Service(s), you are also bound by YoungSkillz’s Honor Code and Code of Community Conduct, which for purposes of this Terms of Use constitute YoungSkillz policies hereby incorporated by this reference.
YoungSkillz provides many services (each a “Service” and together the “Services”) through its website(s) located at www.YoungSkillz.com, and at various physical locations, as well as any other websites and applications owned, operated, or controlled by us (each a “Website” and collectively the “Websites”), including, without limitation, all information, content, services, and materials made available through any Website, social media channels, or other online or onsite channels or offline, physical programs that enable you to participate in any YoungSkillz programs.
YoungSkillz may also offer Online or Offline Courses in partnership with accredited universities and other educational institutions, corporate sponsors and non-profit foundations and institutions (each an “Educational Partner”) whereby academic credit or certification may be offered solely by that Educational Partner. Please see the section of this Terms of Use pertaining to Online or Offline Courses with Educational Partners below for specifics.
YoungSkillz reserves the right, at any time and from time to time, to modify, discontinue, temporarily or permanently, the Services provided or any part or portion thereof, with or without notice to you. You agree that YoungSkillz shall not be liable to you or to any third party for any modifications, suspensions, or discontinuance of the Services, or any portion thereof. Nothing in this Terms of Use shall be construed to obligate YoungSkillz to maintain and support the Services or any part or portion thereof, during the term of this Terms of Use.
YoungSkillz and the instructors of the Online or Offline Courses further reserve the right to alter, modify or rearrange the schedule of topics for the Online or Offline Courses, as well as the point value or weight of assignments, tests, quizzes, exams, projects, and other such evaluations of progress. By attending the Online or Offline Courses, Students acknowledge that YoungSkillz and the instructors maintain the right and ability to adapt, modify or revise the Online or Offline Courses as YoungSkillz and the instructors deem appropriate.
Access: There are different ways in which you may access or use the Services. In each and every instance, you are only authorized to use the Services if you agree to abide by all applicable laws, rules, regulations, as well as this Terms of Use. You may access the Services as:
a "Visitor," meaning any individual that browses any of our Services, including, without limitation, through a mobile or other wireless device without being registered,
a "Student," meaning that you have created a User Account (defined below) registered and/or have enrolled in and paid for access to the Online or Offline Courses and other YoungSkillz’s Services and/or services, content, and/or certification provided by Educational Partners and that you intend to complete the applicable program, including the homework assignments and exams, and other requirements related to those individual programs.
an "Attendee," meaning that you have created a User Account and that you intend to audit the Online or Offline Courses, i.e., attend or view lectures online without accessing final projects or assessments required for certification, or completing the homework assignments, exams or other course work related to assessments for certification.
a “Instructor ” meaning that you have a User Account and have entered into the Instructor Services Agreement with YoungSkillz to provide instruction and project review services to Students.
The term "User" refers to a Visitor, Student, Attendee, Instructor or any other person that participates, interacts with, or otherwise makes use of any of the Services and/or any YoungSkillz community (e.g., moderators, volunteers, or experts-in-residence).
User Accounts: In order to use, access, or take part in many of our Services, including the Online or Offline Courses or to provide Instructor Services, you must select a login identification ("User ID") and a unique user password ("User Password") (collectively, a "User Account"). You agree that you will never divulge or share access to your User Account with any third party for any reason.
In setting up your User Account, you may be prompted or required to enter additional information, including, but not limited, to your name and email address. Additional information may be required to confirm your identity upon setting up your User Account and/or thereafter, for example, to confirm identity prior to receiving a credential of completion of a program. You understand and agree that all information provided by you is accurate, current, and complete and that you will maintain and update your information to keep it accurate, current, and complete. You acknowledge that if any information provided by you is untrue, inaccurate, not current, or incomplete, we reserve the right to terminate your use of the Services and your enrollment any Online or Offline Courses, or a programs, to the extent applicable.
We reserve the right to change or modify these Terms And Conditions at our sole discretion at any time. We will notify you of any material changes to the terms and conditions of this Terms And Conditions or to any service or other feature of the Services and you must accept such changes in order to continue your use and access thereof. If you do not accept such changes your use and/or access to the Services will be terminated. Any change or modification to this Terms And Conditions will be effective immediately upon posting by YoungSkillz on its Websites or applications, or as of the date indicated in the updated Terms And Conditions.
If you are a Student, Attendee, or Instructor, you expressly consent to electronically receive all communications, agreements, documents, notices and disclosures whether transactional or promotional in nature as described more fully in the Privacy Policy You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that you have the ability to store such electronic communications such that they remain accessible to you in an unchanged form.
In connection with your use of the Services we may collect, store, use, share, and/or process certain information about you and your interaction with our Services. For further explanation on how we treat information collected and received from you when you use the Services and/or participate in our Online or Offline Courses, please see our Privacy Policy.
By enrolling in an Online or Offline Course or purchasing any of our Services and providing YoungSkillz with your payment information, you hereby agree to these payment terms. To purchase any services or products offered by YoungSkillz through the Services, you must pay by cheque or have Internet access and a current valid accepted payment method as indicated during sign-up process ("Payment Method"). You agree to YoungSkillz, or its third-party payment provider, storing and accessing your payment information. You also agree to pay the applicable fees for the services or products you purchase through the YoungSkillz Services as they become due, whether on a one-time, installment, or subscription basis. Fees may vary based on your location, the type of Payment Method used, where your Payment Method was issued, or other contractual arrangements. Your transaction with us may be subject to foreign exchange fees or differences in prices, including because of exchange rates. YoungSkillz does not support all payment methods, currencies or locations for payment and may vary such offerings from time to time. Additionally, you understand and agree that not all promotions and pricing are available to all Students, and that specific additional terms and conditions may apply to certain promotional programs, pricing, or geographic locations. You agree to use your own valid Payment Method and not impersonate or otherwise use a Payment Method to avoid regulatory restrictions.
The below refund and cancellation policies apply to our Online as well as Offline programs in all of our locations.
YoungSkillz reserves the right to cancel a program if minimum registration is not reached one week prior to the start date. Program fees will be refunded in full.
If a course is cancelled, I understand that I may enroll my child/ward in another course. I agree to be responsible for any costs for the new program that are above the amount paid for the original course.
I understand and agree that if YoungSkillz is forced to close a course based on a recommendation by the local authorities for reasons such as in the case of a communicable disease outbreak etc. or due to other acts of nature, I will not be entitled to a refund.
A program participant may withdraw from a Summer program 30 days or more prior to the start date for a full refund. A 15% administration fee will be deducted in such a case.
If a Summer program participant withdraws from a program with less than 30 days to 15 days notice prior to the start date, a 50% refund will be issued. A 15% administration fee will be deducted in such a case.
No refunds would be issued for any cancellations less than 15 days prior to the start date of the Summer programs.
Refunds against cancellations for any programs other than the Summer programs would be done at the sole discretion of YoungSkillz Inc.
We will consider program transfers, depending on course minimum registration. The participant will bear the difference in cost in case the fees of the new program is higher than the one they are currently registered in. A 15% administration fee will apply.
I understand that having a photo taken of my child/ward is optional. If I choose to opt in, I authorize that photos, videos, images, audio and testimonials may be taken of my Child/ward and agree that said content may be used by YoungSkillz in promotional materials, marketing collateral, and online media without any charge. These images, testimonials, photos, videos, and audio may be shared and used by corporate partners, the media, or other organizations who work with YoungSkillz. I understand that YoungSkillz, its owners, agents, partners, facility providers, and employees will not be held liable for damages and injuries associated with said publishing, including any and all claims based on negligence. I agree that all images, testimonials, photos, video, and audio taken at or in connection with YoungSkillz are the sole and exclusive property of YoungSkillz. I agree that my child's/ward's personal information, including images, videos and other media may be stored, accessed or disclosed outside of Canada.
I understand that the computer access required during YoungSkillz programs is designed for educational purposes only. I understand that YoungSkillz makes every reasonable effort to prevent participants from being exposed to inappropriate web content. I will not hold them responsible for materials acquired from the network. I understand that in case my student accesses inappropriate content, vandalises accounts and systems, distributes copyrighted material, uses the internet, apps, or text messages to intimidate, put down, spread rumours, or make fun of other participants in the program, my student may be removed from the program without receiving a refund.
On behalf of my child/ward, I, the parent/guardian, in exchange for the right of my child/ward to participate in YoungSkillz program(s), hereby release YoungSkillz Inc., its owners, agents, partners, facility providers and employees from liability (including claims based upon negligence) for any and all damages or injuries to my child/ward or damage of any personal property. I agree to be fully responsible for any and all such damages or injuries which may result directly or indirectly from any negligent acts or activities associated with YoungSkillz Inc. However, I understand that I am not releasing YoungSkillz Inc., its owners, agents, partners, facility providers, and employees from gross negligence, reckless conduct or intentionally tortious conduct. To the extent this release conflicts with state/provincial law governing releases, this release is to be given the fullest force and effect permitted under state/provincial law. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force.
I agree to defend, indemnify, and hold YoungSkillz, its officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorneys' fees and costs, arising out of or in any way connected with my child’s/ward's participation in an YoungSkillz program.
I agree that any dispute arising out of or relating to this Agreement, my child's/ward's participation at YoungSkillz Inc., or otherwise arising between the parties, including, without limitation, any students statutorily created or protected rights, as permitted by applicable state/provincial or federal laws, may be settled by arbitration in the state/province and county in which the program is held, in accordance with the Rules of the local Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The prevailing party in the arbitration shall be entitled to recover expenses including costs and reasonable attorney's fees associated therewith. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force. I hereby acknowledge that I understand the terms of this Arbitration Agreement, and agree to comply with all of its terms and provisions.
